Transgender is the state of one’s “:gender identity which is not matching one’s assigned sex. It is the state where one’s identification as women , man or neither but not matched with identification by others as male or female based on physical/ genetic sex. Simply, transgender does not imply any specific form by sexual orientation, transgender people may identify as heterosexual, homosexual, bisexual, pansexual, polysexual or asexual. Doctor Jhoti said - “Third gender is not a psychatiric patient they are natural person. “

They are as natural persons who have also a right to have one’s own identity. No one have right to forced them to be categorized either as male or female. On dec 21, 2007, Nepal Supreme Court odering the government to dissolve all discriminatory laws against Lesbians, guys, bisexual,transgender and intersex collectively refered tyo as LGBTI and recognized them as third genderaccording to their gender identity. It is the Supreme Court Land mark decision on the issues of LGBTI,  to protect their sexual and gender right as the third gender. Then after suddenly Nepali Lesbian women to receive citizenship papers that proudly denoted her as a third gender status. And now 21^st fo the december is celebrated as National Diversity Day in memory of the momentous Supreme Courtdecisions. In all of the south Asian Countries, Nepal is the first pioneer to host first openly gay member of a national legislature. This was when Sunil Babu Pant elected as a constituent Assembly member in 2008 a new constituion. Nepal Government started to allocate budget for mentioning special programx to them. Stigmatized by the society and misconception of general people about them has been decreased. Sexual assualt, torture, sexual harresment at the hands of police and other authorities, ill treatment, cases of abuse, narrow concept of locus standi and traditional pattern of the court have gone and state recognized their identity as well. “Dream Comes true all these achievments proved it” – lawer or advocate of BDS Hari phyual opined.

At the same time there is one saying that “ There is light in the other side of the tunel.” In 2001 BDS(Blue Dimond Society) establisheed. Its patner organization UNDP are continuously orkking, advocating forn third gender’s due. Third gender Badri pun quoth that “ Media are very great for us, they always cajole  and support us by covering our issues seriously and openly”.

However all these gains are not come up overnight. Much effort and strategies have gone into it, activist have campaigned and lobbied for a long time to influnced Supreme Court to take decision infavour of the sexual minorities. They had to lead secret lives, socially orstracized and often hounded by the law, there could be no public expressing of their sexuality. When their reality revealed as thire gender they are fired from the job, resticated from the academic level, rejected from the inheritances.Society, police, authoritative harrased them as well as pestered them physically and mentally.Society view them as the individual of the other planets and blame them as a psychiatric patients. And this Supreme Court land mark decision collapsed all those bad attitudes towards transgender. Now they have a better life though still some problems remain in the path of their lives.However, Sunil babu Pant and other LGBTI  are hope ful that this constituion will recognized their rights. Only the constituion that allows everyone, regardless of their own background to participate in national life as full and equal citizens can leads the country towards a new Nepal of justice for all. So there is a great deal that hopes and concern of sexual miniorities will reflect in ne constitutions.
